1. Agreement to Terms

By accessing or using AtomiBrain (atomibrain.com), operated by AtomiBrain Ltda., you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of Service

AtomiBrain is a gamified learning platform that uses spaced repetition algorithms to help users master various skills through flashcard-based study sessions. The platform tracks your progress and optimizes review schedules based on your performance.

3. User Accounts

To access certain features, you must create an account using Google Sign-In. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Subscription Plans

4.1 Free Plan

We offer a free tier with access to basic features of the platform.

4.2 Premium Plans

Premium subscriptions are available on monthly and yearly billing cycles. Yearly subscriptions include a discount compared to monthly billing.

4.3 Cancellation

You may cancel your premium subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period, after which your account will revert to the free plan.

5. User-Generated Content

5.1 Your Content

Users may create their own decks and flashcards. You retain ownership of the content you create. By creating content on AtomiBrain, you grant us a license to store, display, and make your content available to you through our service.

5.2 Content Guidelines

You agree NOT to upload, create, or share content that:

• Infringes on copyrights, trademarks, or other intellectual property rights
• Contains material from third parties without proper authorization or consent
• Is illegal, harmful, threatening, abusive, or otherwise objectionable
• Contains malicious code or spam

5.3 Copyright Compliance

You must have the necessary rights, licenses, or permissions for any content you upload. You may not upload copyrighted material owned by third parties without their explicit consent. We reserve the right to remove content that violates these guidelines and to terminate accounts of repeat infringers.

6. Acceptable Use

You agree to use AtomiBrain only for lawful purposes. You must not:

• Attempt to gain unauthorized access to our systems
• Use the service to distribute malware or harmful content
• Interfere with or disrupt the service
• Scrape or collect data from the service without permission
• Use the service for any commercial purpose without authorization

7. Intellectual Property

The AtomiBrain platform, including its design, features, and original content (excluding user-generated content), is owned by AtomiBrain Ltda. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform or its content without permission.

8. Disclaimer of Warranties

AtomiBrain is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy or reliability of any content or learning materials.

9. Limitation of Liability

To the maximum extent permitted by law, AtomiBrain Ltda. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, profits, or other intangible losses.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may also delete your account at any time through your profile settings or by contacting us.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Santiago, Chile.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by posting a notice on the platform or by email. Continued use of the service after changes constitutes acceptance of the modified Terms.
